Terms & Conditions
Limits of use and liability
All products are intended to be used by private gardeners rather than commercial growers or businesses. In good faith we take every care to ensure that the description, illustration, packet contents, instructions and products are accurate and fairly represented but cannot be liable for any direct or consequential loss or damage resulting from any errors, beyond replacing the effected goods or refunding the actual purchase price. Live product may give varying results under different growing and seasonal conditions.
If your products arrive in poor condition or are damaged, please notify us within 7 days and we will arrange for a replacement (if possible) or a full refund. We regret that we cannot replace, or refund products effected by adverse weather conditions, pests or diseases. Upon delivery, if you decide you no longer require the item, it must be returned to us undamaged and in its original packaging, at your cost before we will issue a refund. Your statutory rights are not affected.
Sold Outs
Occasionally, because of high demand or crop failure, a variety maybe oversold. Where this happens, we will endeavour to substitute a variety of similar merit of equal or greater value or offer you a refund if there is no alternative.
Despatch Dates
Despatch dates are given as a guide only and represent the beginning of the despatch period. Some seasonal items can be despatched across several weeks and we always despatch oldest orders first, once items are in stock. Factors outside of our control, such as weather conditions or light levels, may affect live product growth rates and may cause delivery dates to vary.
UK Postage
Postage and packing (p&p) is applied in conjunction with the type of product you are ordering (e.g seed postage and packing is less than postage packaging for potatoes). This will be shown in your order before you proceed to order processing. Please refer to the order form of your latest catalogue for our current Postage and Packing (P&P) charges, we reserve the right to change or amend these at any time. You will only pay once for delivery, no matter how many different deliveries we make to you. P&P charges are incurred in full against the first item despatched from your order and will only be refunded if the whole order is cancelled or refunded.
Overseas Orders
We regret that we can no longer accept any orders for delivery outside of the UK mainland for any products including seed. We reserve the right to cancel and refund any orders inadvertently accepted for delivery outside of the UK.
Orders from customers in Northern Ireland
Proposed non-tariff, phytosanitary customs checks imposed upon us after 1st January, may mean that we will no longer be able to supply any products to customers in Northern Ireland.
Prices & Special Offers
We reserve the right to amend prices or offers according to circumstances at any time. VAT is included where applicable. Free seed offer limited to one per household and are subject to availability. Free seed label quantities are supplied at our discretion. We regret that we cannot resupply free seeds or labels if they are missing from your order. Money off and discount vouchers are strictly limited to one per household, we reserve the right to cancel and refund any order, even if accepted and processed, if we subsequently discover that a discount or special offer has been misused.
Where a discount has been auto applied or quoted within the basket or checkout, this is one code per order, the discounts cannot be stacked or used in conjunction with any other offer.
FREE Seed
Whilst every effort is made to ensure continuity of supply of our free trial seed, on occasion, unexpected demand may lead to these products running out. Where this proves to be the case, it may prove necessary to send your order without these free items in order to avoid unnecessary delay. Please accept our sincere apologies should this prove to be the case. We regret to advise that, for commercial reasons, it is impractical for us to send these items separately from your main order at a later date.
Payment Policy
All goods including seasonally despatched products must be paid for at time of ordering.

Waste Electrical & Electronic Equipment (WEEE) Directive
The EU has introduced legislation relating to recycling "Waste Electrical and Electronic Equipment" ("WEEE"). Currently, most WEEE is disposed of with general domestic waste and is land filled. Separate collection allows WEEE to be recycled; this saves energy and resources and avoids hazardous materials from WEEE going to landfill. On new items of electronic equipment which you buy you will see the symbol:
This symbol means that you should not dispose of this product in your dustbin with your mixed domestic waste. You should dispose of this product separately.
Under these regulations we are obliged to offer our customers free take-back of their WEEE on a like-for-like basis when they buy a new electrical or electronic product from us. Such items can be returned to us (carriage paid by the customer) at our normal address, within 28 days of purchasing the new item. Please mark these items "WEEE return". We will then ensure proper environmental disposal. In helping to separately collect WEEE you will ensure that recycling, as required by the WEEE Directive, takes place and the amount of WEEE being land filled is reduced thereby helping to improve the environment.

Mr Fothergill’s Seeds Limited considers its responsibility to ensure that our suppliers, partners and supply chains operate ethically a corporate priority.
Fothergills intends to ensure that we trade ethically, source responsibly and work to prevent modern slavery and human trafficking in our organisation (including corporate partners) and most importantly, in our supply chain. This will ensure compliance with section 54 of the Modern Slavery Act 2015
This statement relates to our 2025-2026 financial year and Fothergill’s strategy to address any areas of risk. This statement highlights the work we are carrying out to identify and address any modern slavery in our organisation and supply chain. Work is being undertaken to actively identify potential risks through evaluation and audit of compliance.
We are a part of the Chelsea Holdco Limited Group with its head office in the UK. We have a UK based workforce in East Anglia.
We are a major supplier of seeds, plants and related gardening products in the horticultural sector. Sales are both to businesses through wholesale supply and direct to consumer through online web sales.
We have a global annual turnover of £41M.
Our suppliers are based in the UK, Europe and internationally. As part of Fothergill’s growth, we are currently in the process of putting in place an outsourcing of our UK storage and distribution company functions. This outsourcing is to a locally based logistics company partner who shares our ethics and values.
Our policies on slavery and human trafficking
We have appropriate policies in place that underpin our commitment to ensure that there is no modern slavery or human trafficking in our supply chains or in any part of our business or operations. We review and develop our policies on an ongoing basis.
Fothergills are committed to acting ethically and with integrity in all our business relationships and to implementing and enforcing effective systems and controls to ensure slavery and human trafficking is not taking place anywhere in our supply chains
Due diligence processes for modern slavery and human trafficking and next steps
We understand that the following areas give rise to the highest modern slavery risks: sourcing products from suppliers and through the supply chain.
As part of our initiative to identify and mitigate risk we are requiring our suppliers to complete a due diligence audit report to establish their policies, operations and compliance systems to identify risks or potential risks.
From this audit we intend to assess risk areas identified from the audit and address any risks arising or that may arise in the future as a result of information obtained from the audit. This will then allow Fothergills to develop our planned new compliance programme, monitor potential risk areas in the future and protect whistle blowers.

Terms & Conditions for Children Society Promotion
1. Eligibility: The promotion is open to all customers who receive or access the discount code ("Discount Code") through eligible channels.
2. Discount Code Usage:
- The Discount Code entitles the user to a specified discount on purchases made through the Mr Fothergill’s website.
- The Discount Code is valid for one use only per customer. Once used, the Discount Code cannot be reused or applied to subsequent purchases.
3. Non-Combining with Other Promotions:
- The Discount Code cannot be combined with any other ongoing promotions, discounts, or special offers. Only one promotional code can be applied per transaction.
4. Validity:
- The Discount Code is valid for a limited time only. The expiration date and specific terms of the promotion will be provided at the time of issuance. After this date, the Discount Code will no longer be valid and cannot be used.
5. Non-Transferability:
- The Discount Code is non-transferable and may only be used by the individual to whom it was provided.
6. Exclusions:

7. Refunds and Returns:

9. Right to Refuse:
- Mr Fothergill’s reserves the right to refuse the application of the Discount Code in cases of suspected misuse or fraud.
10. General Terms:
- By participating in the promotion, customers agree to be bound by these terms and conditions and the Mr Fothergill’s website's general terms and conditions.
